Please read these Legal Terms carefully before accessing or using the ExamBench platform. By accessing our services, you agree to be bound by all terms, disclaimers, and policies detailed herein.
Agreement to Our Legal Terms
We are Yashodeep Basnet, doing business as ExamBench (“Company,” “we,” “us,” or “our”), a sole proprietorship based in Nepal, with a registered address at Kathmandu, Kathmandu, Bagmati Province 44600.
We operate the website exambench.creviolabs.com (the “Site”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).
ExamBench is an AI-powered educational SaaS platform that converts uploaded student study materials into tailored practice exams (including MCQs, written prompts, and coding questions) and provides automated grading, topic-level performance analytics, and study aids.

1. OUR SERVICES
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
The Services are not designed or intended to process protected health information or other data subject to industry-specific regulatory regimes (such as HIPAA). If your intended use of the Services would involve such data, you may not use the Services for that purpose.
2. INTELLECTUAL PROPERTY RIGHTS
Our intellectual property
We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”).
Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in Nepal, the United States, and around the world. The Content and Marks are provided in or through the Services “AS IS” for your personal, non-commercial use only.
Your use of our Services
Subject to your compliance with these Legal Terms, including the “PROHIBITED ACTIVITIES” section below, we grant you a non-exclusive, non-transferable, revocable licence to:
- access the Services; and
- download or print a copy of any portion of the Content to which you have properly gained access,
solely for your personal, non-commercial use. Except as set out in this section or elsewhere in our Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Your submissions and contributions
Submissions: By directly sending us any question, comment, suggestion, idea, feedback, or other information about the Services (“Submissions”), you agree to assign to us all intellectual property rights in such Submission. You agree that we shall own this Submission and be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. This does not apply to study materials you upload for the purpose of generating practice exams.
Contributions: The Services may invite you to upload study materials, chat, contribute to, or participate in forums, reviews, or other functionality (“Contributions”). Most Contributions on ExamBench (such as uploaded study materials) are processed privately to generate your practice exams and are not made viewable to other users by default.
When you post Contributions, you grant us a licence: By posting or uploading Contributions, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, copy, process, analyse, and reproduce your Contributions solely as necessary to: (a) operate, provide, maintain, and improve the Services for you, including generating practice questions, grading, and analytics from your uploaded materials; (b) provide customer support; and (c) as otherwise required to comply with applicable law. We do not sell, publicly display, broadcast, or commercially exploit your uploaded study materials outside of providing the Services to you.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Legal Terms; (4) you meet the minimum age requirement described above, and if a minor, you have received parental or guardian permission to use the Services; (5) you will not access the Services through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Services for any illegal or unauthorised purpose; and (7) your use of the Services will not violate any applicable law or regulation.
4. USER REGISTRATION
You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
5. PURCHASES AND PAYMENT
All purchases are non-refundable, except as described in Section 26 (Token Utility & Credit Expiration Clause) or as required by applicable law.
We accept forms of payment including Visa, Mastercard, American Express, Discover, PayPal, Google Pay, and Apple Pay. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services.
6. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make the Services available. Prohibited activities include:
- Systematically retrieving data or content to compile databases or directories.
- Circumventing, disabling, or interfering with security-related features.
- Engaging in unauthorized automated scripts, bots, data mining, or scrapers.
- Copying, decompiling, or reverse-engineering platform code or AI architectures.
- Using the Services for academic dishonesty, including live or proctored exam cheating.
- Scraping or extracting question banks or model responses for competitive purposes.
- Manipulating or exploiting the referral program, credit ledger, or token grants.
- Attempting to jailbreak, prompt-inject, or manipulate underlying AI evaluation systems.
7. USER GENERATED CONTRIBUTIONS
Where the Services allow you to submit content beyond private study-material uploads — such as comments, reviews, or forum posts — you represent and warrant that such Contributions do not infringe third-party intellectual property, privacy, or publicity rights, and contain no defamatory or unlawful material.
8. CONTRIBUTION LICENCE
You retain ownership of your Contributions. By posting public reviews or forum feedback, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and distribute those materials in connection with operating the Services.
9. THIRD-PARTY WEBSITES AND CONTENT
The Services may contain links to third-party websites or content. We do not investigate or monitor third-party destinations and take no responsibility for third-party content or purchases made on external websites.
10. SERVICES MANAGEMENT
We reserve the right, but not the obligation, to monitor the Services for violations, take legal action against non-compliant users, disable access to harmful content, and manage the platform to protect our rights and property.
11. PRIVACY POLICY
We care about data privacy and security. Please review our Privacy Policy at https://exambench.creviolabs.com/privacy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms.
12. COPYRIGHT INFRINGEMENTS / DMCA NOTICE
If you believe that any material available on or through the Services infringes upon any copyright you own or control, please send a written notification to our designated copyright agent:
13. TERM AND TERMINATION
These Legal Terms remain in full force while you use the Services. We reserve the right to suspend or terminate accounts for violations of these Legal Terms or applicable law with notice where reasonably practicable.
14. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove contents of the Services at any time. We cannot guarantee uninterrupted uptime due to necessary maintenance, network outages, or updates.
15. GOVERNING LAW
These Legal Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to conflict-of-law principles. Both parties consent to the exclusive jurisdiction of the courts of Nepal for disputes not subject to arbitration.
16. DISPUTE RESOLUTION
Informal Negotiations: Parties agree to negotiate any dispute informally for at least sixty (60) days before initiating arbitration.
Binding Arbitration: Unresolved disputes shall be finally settled under the UNCITRAL Arbitration Rules by a single arbitrator in Kathmandu, Nepal, conducted in English.
Class Action Waiver: All claims must be brought on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding.
17. CORRECTIONS
The Services may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and update information without prior notice.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF DATA. OUR TOTAL LIABILITY FOR ANY CAUSE WHATSOEVER WILL BE LIMITED TO THE LESSER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRIOR TO THE EVENT, OR (B) $100.00 USD.
20. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, or claim, including reasonable attorneys' fees, arising out of your Contributions, your use of the Services, or your breach of these Legal Terms.
21. USER DATA
We maintain data you transmit to manage the performance of the Services. While routine backups are performed, you are solely responsible for maintaining copies of all data you transmit.
22. ELECTRONIC COMMUNICATIONS & SIGNATURES
Visiting the Services and completing online transactions constitute electronic communications. You consent to receive electronic notices and agree to the use of electronic contracts and signatures.

24. MISCELLANEOUS
These Legal Terms constitute the entire agreement between you and us. Our failure to enforce any right or provision shall not operate as a waiver. If any provision is found unlawful or void, that provision is severable and does not affect the validity of remaining provisions.
25. AI OUTPUT & ACADEMIC PERFORMANCE DISCLAIMER
ExamBench uses artificial intelligence models to extract materials, generate practice questions, and evaluate submissions. You acknowledge that AI-generated questions, solutions, and grades may occasionally contain errors, hallucinations, or inaccuracies.
ExamBench is an auxiliary study and practice tool. We make no representation or warranty that using our Services will guarantee passing grades, specific academic marks, or results on any real-world examination. You are solely responsible for verifying the accuracy of all study content against your official institutional syllabi.
26. TOKEN UTILITY & CREDIT EXPIRATION CLAUSE
Credits purchased or granted through ExamBench are non-transferable digital utility tokens with no cash value; they cannot be redeemed, sold, or exchanged for real currency. Credits consumed during normal platform operations (including document processing, test generation, and AI grading) are non-refundable, except as required by applicable law.
Expiration Policy: Purchased credit packs, promotional sign-up bonuses, referral rewards, and daily streak bonuses expire ninety (90) days from the date of issuance, and expired credits are automatically purged and cannot be restored, unless applicable law in your jurisdiction restricts or prohibits expiration of paid credits or gift-certificate-like balances.
27. ACADEMIC HONOR CODE & ANTI-CHEATING CLAUSE
The Services are strictly intended for preparatory mock testing and benchmark practice. You agree not to use the Services during any live, proctored, active, or official school, university, or professional examination, or otherwise in violation of any institution's academic honor code or testing regulations.
We reserve the right to immediately terminate access without refund for any user found violating institutional integrity standards.
